В статье приведены результаты анализа влияния информационно-коммуникационных и цифровых технологий на общественные отношения, регулируемые институтом авторского права, а также обоснована необходимость концептуальных изменений механизма авторско-правовой охраны. Сделан вывод о том, что ряд критериев, в соответствии с которыми результатам интеллектуальной деятельности предоставляется правовая охрана, в некоторых случаях утратил свою значимость. Применение цифровых технологий для создания произведений, а также создание объектов авторского права искусственным интеллектом ставят под сомнение состоятельность критерия творчества как условия авторско-правовой охраны. Предложено пересмотреть существующее правило об отсутствии требования регистрации авторских прав. Обосновано, что в современной жизни значительно изменились условия, которые изначально являлись предпосылками для введения подобных правил в международные акты и национальные законы. Также предлагается использовать цифровые технологии (блокчейн) в соответствующих регистрационных процедурах..
The article presents the results of an analysis of the impact of information, communication and digital technologies on social relations regulated by the institution of copyright, and also substantiates the need for conceptual changes in the mechanism of copyright protection. It is concluded that a number of criteria, according to which the results of intellectual activity are granted legal protection, in some cases have lost their significance. The use of digital technologies to create works, as well as the creation of copyright objects by artificial intelligence, cast doubt on the viability of the criterion of creativity as a condition for copyright protection.It is proposed to revise the existing rule on the absence of a requirement for copyright registration. It is substantiated that in modern life the conditions that were originally the prerequisites for the introduction of such rules into international acts and national laws have changed significantly. It is also proposed to use digital technologies (blockchain) in the relevant registration procedures.
