В рамках исследования проблемы отражена криминологическая структура личности преступника, совершившего преступление в сфере информационно-телекоммуникационных технологий: проведен анализ личности преступника за период с 2014 по 2022 годы, сформированных Информационным центром Министерства внутренних дел по Республике Саха (Якутия), согласно алгоритму формирования раздела 9 «Сведения о преступлениях, совершенных с использованием информационно-телекоммуникационных технологий или в сфере компьютерной информации» государственной статистической отчетности формы № 4-ЕГС1, где общее условие отчета определено перечнем преступлений (Перечень № 25 «Преступления, совершенные с использованием (применением) информационно-телекоммуникационных технологий или в сфере компьютерной информации» Перечня статей УК РФ – далее Перечень № 25)2, введенным Генеральной прокуратурой Российской Федерации с начала 2022 года. Для выявления некоторых особенностей личности компьютерного преступника, определен возраст, пол, уровень образования, гражданство, трудоспособность и социальное положение лица, согласно сведениям статистической карточки формы № 2 «Статистическая карточка на лицо, совершившее преступление»3 выставленной субъектами учета4. При установлении лиц, совершивших преступления в сфере информационно-телекоммуникационных технологий ИТТ) или в сфере компьютерной информации1, правоохранительные органы испытывают трудности с кадровым обеспечением, ведь расследование компьютерных преступлений требует не только правовых знаний и практических криминалистических навыков, но и умений разбираться в системе ЭВМ2 или их сети, также необходимо материально-техническое оснащение и взаимодействие с кредитными организациями, операторами сотовой связи и интернет-сервисов. Вместе с тем основной мерой противодействия данному виду преступлений остается пока только профилактика. В целях совершенствования оперативно-служебной деятельности территориальных органов Министерства внутренних дел Российской Федерации, концентрации усилий личного состава на достижение конечных результатов при выполнении возложенных задач и реализации функций (стимулирования), внесено предложение, в части дополнения в оценочный показатель о количестве раскрытых преступлений в сфере ИТТ, переданных по подследственности без снятия с учета из других субъектов РФ. As part of the study of the problem, the criminological structure of the personality of the criminal who committed a crime in the field of information and telecommunications technologies is reflected: the analysis of the criminal’s personality for the period 2014 – 2022, formed by the Information Center of the Ministry of Internal Affairs of the Sakha Republic (Yakutia), according to the algorithm for the formation of section 9 “Information on crimes committed using information and telecommunications state statistical reporting form No. 4-USGS, where the general condition of the report is determined by the list of crimes (List No.25 “Crimes committed with the use (application) of information and telecommunication technologies or in the field of computer information” The list of articles of the Criminal Code of the Russian Federation (hereinafter List No.25), introduced by the Prosecutor General’s Office of the Russian Federation from the beginning of 2022. To identify some of the personality traits of a computer criminal, the age, gender, level of education, citizenship, ability to work and social status of the person were determined, according to the data of the statistical card form No.2 “Statistical card for the person who committed the crime” issued by the accounting entities. When identifying persons who have committed crimes in the field of information and telecommunication technologies (ITT) or in the field of computer information, law enforcement agencies are experiencing difficulties with staffing, because the investigation of computer crimes requires not only legal knowledge and practical forensic skills, but also the ability to understand the computer system or their network, and logistical equipment is also necessary and interaction with credit institutions, mobile operators and Internet services. At the same time, the main measure to counter this type of crime remains only prevention. In order to improve the operational and official activities of the territorial bodies of the Ministry of Internal Affairs of the Russian Federation, the concentration of personnel efforts to achieve final results in the performance of assigned tasks and the implementation of functions (incentives), a proposal has been made, in terms of additions to the estimated indicator on the number of solved crimes in the field of ITT, transferred under investigation without de-registration from other subjects of the Russian Federation.
