По общему правилу, возможность коммерциализации, то есть введения в оборот с целью получения прибыли, результатов интеллектуальной деятельности вступает в противоречие с п. 4 ст. 129 ГКРФ, согласно которой результаты интеллектуальной деятельности и приравненные к ним средства индивидуализации не могут отчуждаться или иными способами переходить от одного лица к другому, т.е. не являются товаром, необоротоспособны. Инструментом возможности использования интеллектуальной собственности (результатов интеллектуальной деятельности и средств индивидуализации) является обеспечение их правовой охраной. В настоящей статье автором предпринята попытка освятить особенности коммерциализации прав на результаты интеллектуальной деятельности (интеллектуальных прав).
Generally, the possibility of commercialization contradicts paragraph 4 of Article 129 of the Civil Code of the Russian Federation, according to which the results of intellectual activity and equated means of individualization cannot be alienated or otherwise transferred from one person to another, i.e. they are not a commodity, they are non-negotiable. The tool for the possibility of using intellectual property (the results of intellectual activity and means of individualization) is to ensure their legal protection. In this article, author attempt to highlight the specifics of the commercialization of intellectual property rights (intellectual property rights).
