Статья посвящена исследованию положения мер пресечения в системе уголовно-процессуального принуждения. Рассмотрены классификации применяемых в уголовном судопроизводстве мер и средств принуждения. Изучены выделяемые в теории уголовного процесса характерные признаки уголовно-процессуального принуждения, на их основе проанализировано место мер пресечения в системе уголовно-процессуального принуждения, обоснованы критерии разграничения мер пресечения от задержания, иных мер процессуального принуждения и других принудительных средств.
The article is devoted to the study of the position of preventive measures in the system of criminal procedural compulsion. The classifications of measures and means of coercion used in criminal proceedings are considered. The characteristic features of criminal procedural coercion identified in the theory of criminal process were studied, on their basis the place of preventive measures in the system of criminal procedural coercion was analyzed, the criteria for distinguishing between preventive measures from detention, other measures of procedural coercion and other coercive means were substantiated.
