On the issue of delineation of crimes provided for in part 4 of article 111 of the Criminal Code of the Russian Federation and article 105 of the Criminal Code of the Russian Federation
Abstract
The article discusses the issues of delineation of crimes provided for in Part 4 of Article 111 of the Criminal Code and Article 105 of the Criminal Code. The authors, having studied the objective and subjective features of these elements of criminal acts, come to the conclusion that the subjective side of the crime is crucial for distinguishing one element of the crime from another, which is confirmed by the examples from judicial practice.
