Administrative Prejudice in Russian Criminal Law: Mechanisms of Criminalization and Decriminalization

Abstract

This article comprehensively examines the institute of administrative prejudice within modern Russian criminal law as a dual mechanism for criminalization and indirect decriminalization. The research relevance stems from the necessity to balance effective crime counteraction with criminal repression economy. The objective is to analyze the functional role of prejudice in differentiating legal responsibility. The study employs formal-legal and comparative-legal methods, alongside analysis of legislation and Supreme Court practice. Findings reveal that prejudice enables criminalization upon repetition, accumulating public danger, while simultaneously decriminalizing primary offenses. The evolution of norms (Articles 116.1, 158.1, 264.1    of the Criminal Code), theoretical approaches (danger cumulation, special prevention), and legislative criteria are examined. The direct influence of Code of Administrative Offenses changes on criminal liability is substantiated. Issues regarding the non bis in idem principle and punishment proportionality are addressed. The conclusion emphasizes the need for a weighed approach to prejudice-based regulation to ensure legal system justice.
