Abstract

The article presents the results of an analysis of the impact of information, communication and digital technologies on social relations regulated by the institution of copyright, and also substantiates the need for conceptual changes in the mechanism of copyright protection. It is concluded that a number of criteria, according to which the results of intellectual activity are granted legal protection, in some cases have lost their significance. The use of digital technologies to create works, as well as the creation of copyright objects by artificial intelligence, cast doubt on the viability of the criterion of creativity as a condition for copyright protection. It is proposed to revise the existing rule on the absence of a requirement for copyright registration. It is substantiated that in modern life the conditions that were originally the prerequisites for the introduction of such rules into international acts and national laws have changed significantly. It is also proposed to use digital technologies (blockchain) in the relevant registration procedures.

Abstract

Currently there has been an expansion of economic and other activity in the Arctic region, including the extraction of mineral resources on the continental shelf of the Arctic Ocean. It is important to understand the extent of research concerning the mechanism of legal regulation of environmental protection of the Russian Arctic zone. In the science of environmental law there are two approaches aimed at protectionof the environment in the Russian Arctic, the first of which argues in favor of development and enactment of a specific law concerning the Arctic zone of the Russian Federation, the second argues for the necessity of reflecting the distinguishing characteristics of the Arctic in existing legislation. As a result of determining the distinctive environmental features of the Russian Arctic zone and their reflection in Russia’s current environmental legislation, the study offers an improvement of existing mechanisms and a development of new legal protective measures with the environmental distinctions of the Russian Arctic zone being taken into account.
