Abstract

While improving the quality of life, digital technologies, which are developing rapidly and covering more and more social spheres, also carry potential threats, including to the rights and interests of people, organizations, and the state. The development of methods and forms of communication contributes to the emergence of new ethical problems, but the greatest concern is the development of artificial intelligence technologies, which can replace human intellectual work and ensure autonomous decisionmaking, including without human control. The latter circumstance is a serious reason for discussing the ethics of artificial intelligence and the legal regulation of relations related to the use of such technologies.

Abstract

Based on the study of conceptual provisions, the most substantiated, from the author’s point of view, approach to formulating the concept of the doctrine of forensic prognostication and its relationship with forensic forecasting is identified and presented. It is noted that these concepts are correlated as “teaching – teaching method”, and the forecasting method, as the main one in forensic prognosis, combines a set of other methods used to form a forecast. The range of objects, subjects, types and methods of forensic forecasting were considered. New approaches to the practice of forensic forecasting were studied.

The article examines transformations in the forensic system caused by the processes of digitalization and informatization; the need for the formation of a new direction in forensic science – digital forensics – is outlined. The positions of scientists on the formulation of the concept of “digital forensics” and the definition of its place in the system of forensic science are identified and studied; prospects for the development of areas of digital forensics and the formation of its main provisions are presented.

Abstract

In recent years, attempts to falsify Russian and world history, distort historical truth and destroy historical memory have become more frequent. As a result, amendments to the Constitution of the Russian Federation in 2020 introduced a new norm regulating processes aimed at preventing, disclosing and suppressing distortions of historical facts, events and personalities of our Motherland. The creation of a new legal mechanism for the protection of historical truth contributes to the formation of the historical memory of the nation, the strengthening of national identity.

Abstract

This article is devoted to the peculiarities of regional state environmental control (supervision) in the Sakha Republic (Yakutia). An analysis of the legislation on compensation for damage caused to the environment was carried out, including the Decree of the Government of the Russian Federation of March 10, 2022 No.336 “On the peculiarities of the organization and implementation of state control (supervision), municipal control”, restrictions were introduced regarding the types of control, in connection than there are problems in forcing individuals and companies to compensate for environmental damage.

Abstract

As part of the study of the problem, the criminological structure of the personality of the criminal who committed a crime in the field of information and telecommunications technologies is reflected: the analysis of the criminal’s personality for the period 2014 – 2022, formed by the Information Center of the Ministry of Internal Affairs of the Sakha Republic (Yakutia), according to the algorithm for the formation of section 9 “Information on crimes committed using information and telecommunications state statistical reporting form No. 4-USGS, where the general condition of the report is determined by the list of crimes (List No.25 “Crimes committed with the use (application) of information and telecommunication technologies or in the field of computer information” The list of articles of the Criminal Code of the Russian Federation (hereinafter List No.25), introduced by the Prosecutor General’s Office of the Russian Federation from the beginning of 2022. To identify some of the personality traits of a computer criminal, the age, gender, level of education, citizenship, ability to work and social status of the person were determined, according to the data of the statistical card form No.2 “Statistical card for the person who committed the crime” issued by the accounting entities. When identifying persons who have committed crimes in the field of information and telecommunication technologies (ITT) or in the field of computer information, law enforcement agencies are experiencing difficulties with staffing, because the investigation of computer crimes requires not only legal knowledge and practical forensic skills, but also the ability to understand the computer system or their network, and logistical equipment is also necessary and interaction with credit institutions, mobile operators and Internet services. At the same time, the main measure to counter this type of crime remains only prevention. In order to improve the operational and official activities of the territorial bodies of the Ministry of Internal Affairs of the Russian Federation, the concentration of personnel efforts to achieve final results in the performance of assigned tasks and the implementation of functions (incentives), a proposal has been made, in terms of additions to the estimated indicator on the number of solved crimes in the field of ITT, transferred under investigation without de-registration from other subjects of the Russian Federation.

Abstract

It is concluded that the state, as the owner of subsoil, in order to ensure rational, comprehensive and efficient use of subsoil within the framework of management of the state subsoil fund, exercises its property right by applying such measures as early termination of the right to use subsoil. The study is aimed at analyzing this legal mechanism as a means of protecting the rights of the state, going beyond the scope of legal liability. The purpose of this study is to come to an understanding of the legal nature and role of early termination of the right to use subsoil as a specific form of government intervention, which evaluates violation of the conditions for use of subsoil as grounds for termination of this right. The authors come to the conclusion that there is an unbalanced legal regulation of the procedure and grounds for early termination of the right to use subsoil in relation to subsoil users of the Arctic zone of the Russian Federation and small and medium-sized businesses.

Abstract

The article discusses the problematic aspects of using the results of operational investigative activities in proving criminal cases. The analysis of investigative and judicial practice has shown that the courts, when verifying evidence formed on the basis of the results of the ORDO, pay special attention to compliance with the requirements of the legislation on operational investigative activities and the Code of Criminal Procedure of the Russian Federation in terms of fixing and processing information obtained operationally. It is concluded that the information provided by the bodies carrying out the ORDO and their objectified media that meet the requirements of the law, including the requirements for evidence, can be used in criminal procedural proof.

Abstract

The article is devoted to the rather complex and confusing topic of the formation of the Sakha (Yakut) ethnic group. This complexity stems from the equally obvious role and influence of the autochthonous Tungus-Manchu tribes. As is known, Tungus-speaking tribes are divided into two large groups: northern and southern. The northern group is mainly represented by the Tungus (Evenks) of Yakutia. The southern group includes the Tungus-speaking tribes of the Amur region and Sakhalin Island. Studying the history, life and way of life of the largest of the Paleo-Asian peoples – the Tungus (Evenks) – will help restore a more complete picture of the history of not only the Lena region, but also the whole of Central Asia.

Abstract

The truth in any matter is achieved as a result of long and persistent discussions. The relevance of the topic proposed by the authors lies in the debatable perspective on the history of the ethnogenesis of the Sakha people. The purpose of this article is the desire of the authors to contribute to the understanding of the issue of the participation of the Khoro tribes in the formation of the Yakut ethnic group, which would contribute to the solution of many “blank spots” in the history of the entire Lena region. The scarcity of the written historiographical base makes it possible to highlight only some aspects of the ancient history of the peoples of the region.

Abstract

The relevance of this study is due to the need to study the nature and characteristics of the socio-economic processes that took place in small settlements of the Yakut region at the end of the 19th – beginning of the 20th centuries. Many people in Yakutia lived in small villages, lost in the taiga, on the bends of rivers and alas. If in the central regions of the Russian Empire there was a rapid development of capitalism, then on its outskirts, if there were changes, they were in nascent forms. The purpose of this study is to study the changes that took place in the village of Bolshoi Patom, Olyokminsky district. To achieve this goal, we set ourselves the following tasks: to study archival material – census records of the First General Census of 1897 and the Agricultural Census of 1917; analyze the changes taking place in the village; establish the size, national composition, and activities of the population; identify the features of socio-economic processes that occurred over the 20 years between censuses. We used the following methods: the principle of historicism, the descriptive method, historical-comparative analysis, when studying census forms, we used the statistical method.

Abstract

The scholarly article, based on the analysis of archival documents, periodicals, and published materials, examines the attitude of political organizations in Yakutia to the establishment of the Soviet power in the summer of 1918. The political situation that had developed in the Yakut region by the summer of 1918 is analyzed. The history of the organization of the Centrosiberian expedition under the command of A. S. Rydzinsky to Yakutiaand the establishment of the Soviet power in the region in the summer of 1918 are shown. Conclusions were drawn that the right Socialist Revolutionaries, federalists and Cadets were opponents of the Soviet power, and the Bolsheviks, Mensheviks, and left Socialist Revolutionaries supported the Reds. The peculiarities of the political situation in the Yakut region, the remoteness of the region from the center of the country, the course of the armed confrontation in Siberia predetermined that Soviet power lasted in Yakutsk for just over a month in the summer of 1918, and its final establishment occurred only after the end of the civil war.

Abstract

The adoption of any legal norms pursues certain goals. This rule also applies to criminal law norms with administrative prejudice. The achievement of such goals in conjunction with compliance with the general principles of legal regulation ensures the necessary effect. At the same time, criminal law science has not developed a unified concept of interpretation of the essence of the effectiveness of criminal law norms with administrative prejudice. In this regard, the article aims to determine the essence of their effectiveness, as well as the main features of this category as features of some norms. To achieve this goal, existing approaches to the interpretation of the effectiveness of legal norms were analyzed, in general, signs of effectiveness as features of the rule of law were identified. The latter were correlated with signs of criminal law norms with administrative prejudice to establish the true essence of their effectiveness.

Abstract

The article examines the role of Mikhail Nikolaev,the first President of the Sakha Republic (Yakutia), in the development of our republic and country, during the period of global changes in the life of society. The authors of the article consider various aspects of the multifaceted activities of the recognized leader of our people, thanks to which our republic occupies its rightful place among 89 subjects of the Russian Federation. The relevance of the article lies in the fact that due to the strategic course determined by Nikolaev and implemented by the successors of his cause, the popularly elected leaders of the SR(Y) V. A. Shtyrov, E. A. Borisov and A. S. Nikolaev, our republic has made and continues to make its worthy contribution to the development of Russian federalism and strengthening the unity of our multinational and multi-confessional Homeland, during the period when we celebrate the 30th anniversary of the Constitution of the Russian Federation and will participate in the next eighth presidential elections of the Russian Federation in March 2024, and also began active preparations for the 400th anniversary of Yakutia’s entry into the Russian state, which will be celebrated in 2032. The aim of the research is to create an image of a true leader who can inspire and become a role model for current and future generations of activists, public figures and politicians at the regional and federal levels. The objectives of the study are to determine the effectiveness of regulatory regulation in order to achieve high results in government activities. The authors conclude that today the ideas and initiatives implemented in the regulatory decisions of the first President of Yakutia M. E. Nikolaev are successfully implemented in the region and, moreover, are scaled to the federal level and are highly appreciated in the world community.
